A PWLLHELI man has been cleared of fracturing the arm of a five-week-old baby boy.
The prosecution at Mold Crown Court said that considerable force must have been used to cause such an injury.
Defendant Jonathan Edward Simpson, 34, accepted that he must have caused the injury but said that it had been accidental while undressing the tot.
He denied a charge of inflicting grievous bodily harm on the baby and was cleared by a jury at Mold Crown Court.
Simon Mills, prosecuting, said the infant suffered a spiral arm fracture to the upper left arm during an incident on 3 November, 2014.
The medical evidence was that “considerable force” would have to be used to cause such an injury, he said. There was nothing medically wrong with the baby’s bones.
Thousands of babies were changed every day without their arms being fractured, he said, and described Simpson’s explanation as implausible.
Simpson, of Bro Cynan, told the jury he was pushing the pram and the baby started crying.
He went inside, got the baby out and was taking his top off. He held him in his arms and slipped one arm out, then held him to the other side to get the other arm out, sliding him across his own chest.
The baby continued to cry and he noticed when he gave him a bottle that his left arm was floppy.
