POWYS County Council has launched an investigation following the felling of trees at Y Plas in Machynlleth.
A number of trees have been removed following complaints from the public to Machynlleth Town Council.
Town council clerk Jim Griffiths said an investigation was carried out and it was found that there were a number of diseased trees at the site. He said the council sought advice from a number of people before the trees were removed.
“Following complaints from local residents regarding the danger posed by falling branches near to their property and cars, an investigation was carried out and a number of beech trees were found to be badly diseased and posing a potential risk,” he said.
“A number of nearby larch trees were also dead and broken and in need of removal.
“The services of a tree surgeon were sought, and I contacted the town council insurance company for advice.
“I was advised by our insurers that now the matter had been confirmed that the trees were a potential danger due to rot then any damage they may cause was no longer covered by our indemnity insurance and any resulting claims would not be met."
The clerk added: “I then took advice regarding the potential of felling trees in an historical garden which may be covered by a blanket Tree Protection Order.
“We were informed and given printed guidance by Powys County Council that if the trees were deemed to be so dangerous then an exemption for planning/felling consent existed.
“No nesting site or other protected habitat was compromised.”
He added: “Machynlleth Town Council takes very seriously its responsibilities in this matter and is loathe to cut down any trees on its grounds without undue reason. However, in this situation I was not left with much choice in dealing with the matter in the way I did.
“Natural Resources Wales have been and carried out an investigation and there is no prosecution pending or any further action. No laws broken - all safe.”
However, a spokesperson for Powys County Council said it was investigating the matter further.
