A CWMANN man has escaped prison after magistrates decided not to activate his suspended sentence.
Daniel Ian Rogers, 30, admitted breaching the suspended sentence after missing a string of appointments with the probation service in March.
Magistrates heard that Rogers had been made subject to the suspended sentence after breaching a restraining order in March 2014 to keep him away from his former partner Samantha Ruysch.
He avoided being sent to prison, but has appeared before magistrates again for breaching the order.
His solicitor, David Williams, said he had been made homeless at the time and had been trying to win access to his children, which led to him failing to keep his appointments and keep in touch with the probation service.
Mr Williams said Rogers now realises “what he has got to lose” if he is sent to prison for failing to meet the requirements of the suspended sentence.
He said that Rogers had made an “exemplary start” to the order in the first seven months, with problems only starting when he lost his accommodation.
Aberystwyth magistrates backed a recommendation from the probation service that instead of sending Rogers, of 31 Heol Hathren, to prison, he should be made subject to a curfew between 7pm and 7am for an eight-week period.
Magistrates warned Rogers that it was his final chance and that if there was a further breach of the order it was very likely to be activated. The suspended sentence will remain in place.
Rogers was also ordered to pay costs of £85.
