A New Quay woman who discovered her partner was “cheating” on her with a friend was arrested for drink-driving after moving his van away from her house.
Charleen Muggridge, of Newlyn, 4 Queen Street, admitted drink-driving and driving without insurance on 6 September.
Her solicitor, Alison Mathias, insisted Muggridge had only driven the van a very short distance to get her former partner’s van away from her home.
Prosecutor Helen Tench said police had received an anonymous call at around 1.30am saying there had been an argument and that a woman who was thought to have been drinking was about to drive away.
Police found Muggridge, 33, driving the van and stopped her.
Muggridge admitted that she had been angry and had taken the keys to move the van.
A breath test showed she had 63 microgrammes of alcohol in 100 millilitres of breath, almost twice the legal limit of 35.
She told officers she didn’t know if she was insured to drive the van or not, with checks showing that she wasn’t a named driver on the policy and she had no individual policy.
Ms Mathias said Muggridge, her then partner and a friend had been drinking at their home when Muggridge went to bed.
She was woken by her daughter crying and screaming after seeing her mother’s partner “getting quite friendly” with the other woman.
Muggridge then packed up some of his belongings and put them in the van, which she drove a short distance down the road as she wanted her former partner to leave.
While Ms Mathias said Muggridge had only driven a short distance, she accepts she shouldn’t have driven the van after drinking and said a driving ban was going to make things difficult.
She said: “She realises because of a foolish decision, she’s made life extremely difficult for herself, her family and her employer.”
Muggridge was banned from driving for 17 months, was fined £120 and will pay costs of £115.
