A Cardigan barber who was moving his car from a restricted space was arrested on suspicion of drink-driving, and then failed to give a breath sample, telling police he had the flu.
Justin Hulett, of 31 William Street, pleaded guilty to failing to provide a specimen of breath.
Magistrates heard that he had given one sample, which showed a reading of around two-and-a-half times the legal limit, but that he had been unable to provide a second sample.
Ceri Ellis Jones, prosecuting, said Hulett had been stopped shortly before 4am on Saturday, 28 September, and police officers smelt alcohol on Hulett’s breath and saw he was unsteady on his feet and slurring his words.
She said that Hulett had been unable to provide a roadside sample as he didn’t listen to the instructions. Then after giving one sample at the police station, he couldn’t give the required second sample as he said he had flu and was struggling to breathe.
Defence solicitor Alan Lewis said 39-year-old Hulett had not been intending to drink that night, but had done so after having a row with his then partner.
Mr Lewis said Hulett drove a short distance to move his car to a spot where he could leave it the next day, but accepted that was a foolish decision.
Hulett was banned from driving for 12 months. He was fined £385 and will pay costs of £123.
