ABERYSTWYTH magistrates have granted an order allowing access to land near Cardigan to carry out work on a footpath.
Lyn Jenkins, the owner of Cardigan Island Coastal Farm Park, Llys-yr-Ynys, Gwbert, has battled with Ceredigion council since 2006 over a section of the coastal path which cuts along his land.
Jenkins took his fight to the highest levels, appealing to the Court of Appeal – which found against him in 2010 after almost five years and over £120,000 in legal fees spent fighting to keep his park private.
On Monday, the case went before Aberystwyth magistrates after Ceredigion council issued a complaint for a civil order to be made to allow officers access to the site.
Ceredigion council’s officer said it is “necessary for him to enter the Cardigan Island Coastal Farm Park for the purposes of executing and maintaining works and ascertaining and fixing boundaries on the public footpath”.
The civil order says that on 8 June last year Jenkins “refused to permit the premises to be entered”.
Magistrates on Monday granted the order to allow officers access to Jenkins’ land to carry out work on the footpath.
