A MAN who attacked his partner after she refused his sexual advances was warned by magistrates he was lucky not to be jailed because of the serious injuries he inflicted.

Daniel Robert Biles, 29, was convicted of two charges of assaulting Carol Rhodes despite pleading not guilty and claiming that Ms Rhodes may have suffered the injuries while the couple were “play fighting”.

Rhian Jones, prosecuting, said Ms Rhodes told police that Biles had returned to their home at around 5am and had pestered her for sex, which she refused.

Biles, who gave the court a bail address of 123 Lodge Crescent, Netherton in Dudley, but will be returning to live in Aberystwyth, became angry and shouted abuse at Ms Rhodes.

Ms Rhodes went upstairs and Biles followed her before sitting on the bed and squeezing her hand tightly, saying that he could “have anyone I want” before he put his hands on the side of Ms Rhodes’s head and bit the top of her head.

He then pulled her from the bed, before following her downstairs and standing over her. Ms Rhodes stood up but Biles picked her up and threw her onto the sofa before getting on top of her and then threatening to “roundhouse kick” her.

Ms Jones said Biles then slapped Ms Rhodes, pushed her to the ground and stood on her hand.

Biles claimed the bruises she had suffered may have been from the couple play fighting. Defence solicitor Alison Mathias said Biles now realised the couple’s relationship was over.

Presiding magistrate Brian Ashton told Biles: “We consider these offences very serious. So serious that you’re lucky we aren’t phoning for the van to take you to Swansea.”

Biles was given a six-month prison sentence, suspended for 18 months. He was ordered to complete 20 rehabilitation activity requirement days and a thinking skills programme.

Magistrates also imposed a restraining order and ordered him to pay compensation of £300 and costs of £760.
