Your report (‘Strict’ car parking time limit slashed at retail park, 23 September) is incorrect and misleading in stating that people who park their vehicles for longer than 90 minutes “will attract a £90 fine”.
A fine is a penalty that can only be imposed by the state for a violation of the criminal law.Lidl has no authority to impose fines.
When you park in the Lidl car park (has anyone ever called it the Rheidol Retail Park?), you are entering into a contract with Lidl.
Overstaying is a breach of that contract, but nothing more. If you receive a letter demanding money for overstaying, read it carefully.
You will see that the language is designed to make you feel that you have committed an offence, but it never mentions a fine. I know; I have received several.
The worst that they can do is to sue you for breach of contract. They almost certainly won’t. You are not breaking the law when you overstay at Lidl car park.
